Some of the services the legislature would consider cutting include optional medical supplies and equipment such as bath supplies and bath shoes; dental services such as cosmetic surgery beyond a basic level; some speech and physical therapy services; optional optometrist treatments; some private nursing services above a basic level of care; and some upgrades to eyeglasses and dentures, including multiple replacements.

If the opt out is granted, Crist said medical professionals would be consulted to help counties decide how to determine which programs to reduce.

Rich Crist, a spokesman for the majority, said that most of these cuts would focus on Medicaid, which he called "the largest and costliest unfunded mandate in the county," ringing in at about $40 million in annual costs, and contributing to what he called the state's "Cadillac level of care." While programs would not necessarily have to be cut completely, Crist said legislators would like the opportunity to "have greater control over how these services are provided and an opportunity Under Armour Clutchfit 3.0 Red

"Does that mean for some poor child that's missing a broken tooth in the front, he can't get a cap?" Grimm asked. "I'm not a medical expert, I don't know what the differences are and they're not defined (by the majority). So it's hard to make a comment."

optional services, and legislators said it is the only state that requires counties to pay for a portion of the costs of all of them.

"None of this would affect basic care services," Crist said. "Nobody gets put out of the hospital or (denied) eyeglasses or something like that. This is optional stuff, replacement things, cosmetic surgery, electives, things like that."

TROY Members of the Rensselaer County Legislature majority will file a resolution during the body's next meeting asking the state to consider giving counties the choice to opt out of certain mandated services that are not federally required.

The push is an effort for the county to control its costs and potentially lower its tax rate, Republican legislators said. Majority Leader Ken Herrington noted that giving counties more control over what optional services they provide is a more feasible request than hoping the state "provides tens of millions of dollars to counties for mandate relief."

Republicans are asking for a so called "reverse mandate" where they would be allowed to opt out of some of those optional services, adding that the state could in exchange require Rensselaer County to apply some of the savings that move generates to tax relief.

Rensselaer County Legislative majority proposes different approach to mandate relief

But Minority Leader Peter Grimm said he was still concerned that the resolution painted too much of a "broad stroke" when it came to articulating possible places to cut, and worried that some of its proposed areas to cut such as dental cosmetic surgery are hard to interpret without more information.

Grimm added that he and his fellow Democrats were supportive of ideas that would relieve some of the mandate burden, but cautioned that making uninformed cuts, at least at this juncture, would be unwise.

"There are many programs that are critical and necessary programs that we just can't shoot from the hip and say, 'Let's get rid of them and have more control over them,'" he said. " . Service opt outs would not include programs that provide needed shelter, food or medical treatment, majority members said.
