The worker, who has been fired, slammed the girl's head against a concrete wall, according to testimony in a state unemployment hearing. The Register has requested the video since May 2013.The second lawsuit was filed by the Register against the Iowa Department of Public Safety and Commissioner Larry Noble in an effort to obtain law enforcement reports in the death of Michael Zubrod, 39, of Charles City, who was subject to multiple Taser jolts while in the custody of Worth County deputies on Sept. 22, 2013. The Register has requested the reports since the incident occurred, and the case is now closed.READ THE LAWSUITS filed by the Register on FridayThe lawsuits were filed simultaneously to send a message that the Register will fight for openness in government and accountability while serving its readers, Register Editor Amalie Nash said."We take seriously our responsibility to ensure Iowans know how their tax dollars are spent and how government officials are operating," Nash said. "We have two examples of high profile cases that are being shrouded in secrecy. The public has a right to see records in these cases, and we remain hopeful that the state agencies involved will take steps to prove they are transparent to the citizens they serve."Keith Luchtel, executive director of the Iowa Public Information Board, said Friday that the board stands behind its decision. He had no other comment.Iowa Department of Public Safety spokesman Sgt. Scott Bright said officials received copies of the lawsuit on Friday afternoon and hadn't yet read or analyzed it."We really can't comment on it because we haven't read the whole thing," Bright said. the facility had been repeatedly placed in isolation and denied educational opportunities.The Iowa Department of Human Services has declined to release the Iowa Juvenile Home video, arguing it is a medical record that must be kept confidential and that the state could lose federal funds if it made the recording public. The Register appealed DHS' decision to the Iowa Public Information Board, which sided with the DHS last month in a 6 3 vote to keep the video secret. The worker shown in the video has been criminally charged.The Register's lawsuit seeks to reverse the Public Information Board's decision, arguing the panel's reasoning was incorrect and failed to take relevant information into account. The lawsuit also points out that the Department of Human Services released a similar video in May 2013 and even purchased special software to blur a teenager's face in that video before refusing to release the second video."That denial (to make the second video public) was inconsistent with the prior practice of DHS and raised serious questions whether it was motivated by and in retaliation for the Register's prior and ongoing news reporting about abuse, misconduct, and mismanagement at the Iowa Juvenile Home," the lawsuit argues.In the Taser case, the Iowa Division of Criminal Investigation which conducted a review of the Worth County officers' conduct has twice refused to provide records, most recently saying they would remain permanently sealed, according to the second lawsuit. The state medical examiner's office ruled Zubrod's death a homicide.
